Why and How Export Rebates Need Not Qualify as a ‘Financial Contribution’, and thus No Subsidy under WTO Rules
Just published: my article in the Global Trade and Customs Journal on the EU TS and losing the export‑bound carbon‑leakage loophole.
It examines whether a mechanism for export rebates on ETS costs could be put in place without triggering WTO subsidy rules. Export rebates are not ipso facto subsidies.
